Alternative Dispute Resolution (ADR) - Mediazione familiare

"Family mediation, when applied to conflicts related to the personal separation of spouses, can be seen as an opportunity for the couple to begin communicating with each other again in a way that is functional to crisis management" (J. Coogler).

Family mediation is a confidential practice aimed at managing family relationships through a qualified and impartial mediator. This practice now represents a crossroads between psychological and legal fields and is aimed at couples, whether married, cohabiting, or in a civil union, with or without children, who are going through separation or are already separated or divorced. One of the primary objectives is to facilitate the maintenance of the principle of joint parenting (where applicable), including the coordination of relationships with minors.

The use of this tool has increased considerably since the adoption of Law No. 54/2006. The parties involved, their lawyers, the judge, social services, or the Children's Ombudsman can initiate the family mediation process at any time.

Rather than dealing with conflict as in a court of law, where a clear winner is often sought, (voluntary) mediation focuses on a collaborative approach. Couples work together to find solutions that work for both parties, creating common ground rather than ongoing conflict. Voluntary mediation is often faster and more cost-effective than traditional legal proceedings, saving time and resources. This efficiency not only helps resolve issues more quickly but also alleviates emotional and financial stress.

By resolving disputes peacefully and consensually, mediation improves future relationships between partners. This is especially important when couples must continue to co-parent. Ultimately, family mediation not only resolves immediate problems but also promotes a healthier and more constructive relationship in the long run.

Here are the main phases of ADR*

Identification of Issues

Exploring Interests and Needs

Negoziazione e Costruzione dell’Accordo

Formalizzazione dell’Accordo

L'accordo raggiunto viene redatto in forma scritta.

Chiusura e Follow-up

The mediator concludes the process by summarizing the agreements reached and discussing the next steps the parties must take. This final phase may also involve follow-up to ensure the agreement is being respected and effective.

*These phases are flexible and can be adapted to the specific needs of each couple , but overall they are designed to provide a clear structure and a fair process that helps the parties reach mutually acceptable solutions. Please note that our mediation service refers exclusively to so-called "voluntary" mediation , which is a solution that "allows the parties involved in a dispute to reach an agreement without having to resort to a judge." For "mandatory" mediation cases identified pursuant to Article 5, paragraph 1-bis of Legislative Decree 28/2010 (an alternative to ordinary judicial protection), it is necessary to initiate "a process in which a neutral, impartial, and independent third party called a Mediator facilitates communication between the parties involved in a dispute with the aim of reaching an agreement, using negotiated mediation techniques learned in specific mandatory training courses. Unlike judicial proceedings, mandatory mediation requires the parties and their respective lawyers to actively and loyally participate in the search for solutions, promoting constructive dialogue."

Family mediation is an extremely important process, especially when it comes to addressing conflicts between family members. One of the main positive aspects of mediation is its ability to improve communication. During conflicts, emotions can run high, and conversations can quickly degenerate into misunderstandings. An experienced mediator can intervene to facilitate respectful dialogue, allowing each party to express their concerns and listen to the other.

Another crucial aspect of family mediation concerns the well-being of children, when they are involved. A mediator ensures that the focus remains on the needs of the children, promoting solutions that foster balanced co-parenting and emotional stability. In this way, agreements can be created that, while addressing the challenges of adults, take into account the needs of the little ones.
