NIS2 Directive: New Cyber Requirements for Businesses

"Everyone has the right to life, liberty and security of person" (Art. 3 of the Universal Declaration of Human Rights, 1948).

Directive (EU) 2022/2555 of the European Parliament and of the Council of 14 December 2022 on measures for a high common level of cybersecurity across the Union, amending Regulation (EU) No 910/2014 and Directive (EU) 2018/1972, and repealing Directive (EU) 2016/1148 (NIS 2 Directive) aims to strengthen cybersecurity in all Member States in order to improve the functioning of the internal market. This directive updates and replaces the previous NIS (Directive on Security of Network and Information Systems) of 2016 and introduces more stringent measures to ensure a high level of information security within the EU.

NIS2 will be implemented in the Italian legal system through Law 90/2024 and the bill presented to the Chambers as Government Act No. 164, currently under review.

This isn't just about legal compliance, but a real opportunity to strengthen an organization's market position, earn customer trust, and ensure service continuity in the event of an incident. Preparing to meet NIS2 requirements isn't just a mandatory step, but a proactive strategy for addressing cybersecurity challenges. Investing in adequate security measures and an incident management plan will bring tangible benefits, allowing you to effectively manage risks and defend your business from potential threats .

Beyond Cybersecurity: The Value of Risk Management and the Mandatory Incident Reporting

One of the most significant aspects of the NIS2 Directive is the imposition of security obligations on organizations included in its scope. Specifically, it requires the adoption of adequate and proportionate security measures to ensure the protection of networks and information systems from cyber attacks and incidents. Article 14 of the Directive clearly states that covered entities must implement technical and organizational measures to prevent and mitigate network security risks, thus contributing to protecting the integrity and confidentiality of the information processed.
Implementing the security measures required by the NIS2 Directive represents an organization's tangible commitment to protecting sensitive information, thus inspiring customer trust. The ability to ensure an adequate level of cybersecurity has therefore become a key factor in customer loyalty and competitive positioning in the market.
